The Labour Court upheld a €7,500 award to Richard Dillon after Papsta Ltd appealed a Rights Commissioner decision on his working hours and rest breaks. The determination was signed on 6 May 2010.
Papsta Ltd accepted that breaches occurred but argued the award was excessive, citing the unusual nature of the work and its mistaken understanding of the law. Dillon said he had raised his concerns directly and that they went unaddressed for more than two years. The Court noted that he regularly worked 24-hour shifts on three days each week, without a break. It said the infringement of the right to adequate rest could not be treated as merely technical, and lack of knowledge of the statutory duty was not a mitigating factor.
