The Labour Court upheld a €1,000 award to Daria Kalkowski (Nee Gawalko) after rejecting Marc O’Mahony’s appeal. The determination was signed on 23 February 2010. Kalkowski, represented by the Services Industrial Professional Technical Union, said she had not received Sunday premium, annual leave or public holiday entitlements. O’Mahony, trading as The Good Food Shop and formerly as Premier Organics, said they had been paid and that Sunday premium was included in her rate. The Court found O’Mahony had not produced records to support his position or kept adequate records showing compliance. It found breaches of the Organisation of Working Time Act 1997 and upheld the Rights Commissioner’s decision.
