The Labour Court upheld a €5,000 award to Jurijs Kolesniks after dismissing East Coast Recycling Limited’s appeal for lack of prosecution. The determination was signed on 27 October 2010.
Kolesniks had claimed that he regularly worked more than 48 hours a week. The Rights Commissioner found in his favour and awarded €5,000 for breaches of the Organisation of Working Time Act 1997.
East Coast Recycling did not attend the Labour Court hearing. Its legal representative wrote that the company was no longer trading and that he had no instructions. The Court dismissed the employer’s appeal and upheld the earlier decision.
