Labour Court upholds €800 award to Zbigniew Gurgul

The Labour Court upheld an €800 award to Zbigniew Gurgul in his working-time complaint against Peadar Kelly Landscaping Limited. The determination was signed on 8 October 2010. Gurgul alleged that the employer failed to provide statutory rest breaks on days he worked overtime. The employer appealed and said he had received the required breaks. The Court found that the employer had failed to keep required records and had not produced evidence proving compliance, so it rejected the appeal and upheld the Rights Commissioner's award.
