The Labour Court upheld a €3,000 compensation award to Krzysztof Fabin after his employer, Liam Carroll Refrigerated and Dry Freight Haulage Limited, appealed a finding that he had been required to work excessive hours. The determination was signed on 6 October 2010.
Fabin said he normally had to work up to 78.5 hours a week. The Rights Commissioner upheld his complaint under the Organisation of Working Time Act 1997 and awarded him €3,000. The employer appealed but did not attend the Labour Court or file submissions setting out its position. The Court said the appeal failed and confirmed that the employer must pay the compensation.
