The Labour Court overturned a €4,000 award to Inart Vitols after allowing Cara Commercial Merchandising’s appeal. Its determination was dated 8 September 2010.
Vitols complained that he worked more than 48 hours a week, did not receive proper breaks and lacked advance notice of changes to his working hours and overtime. The Court found no breach of the rules on weekly hours, breaks or notice. Delivery records supported its finding that he had not exceeded the weekly limit; it also found he had been told to take breaks and that the delivery roster allowed for them. The Court set aside the Rights Commissioner’s decision.
