The Labour Court upheld Clare Civil Engineering Limited’s appeal and set aside the €7,500 award to Vladislav Arbuzous. The determination was dated 10 September 2010.
Arbuzous alleged breaches involving weekly hours, daily rest, breaks and record-keeping. The Court found the company complied with rules on hours, rest and breaks, but failed to keep records in the prescribed manner. It said that breach was an offence and not a matter for an employee complaint; the merits were not decided on that issue. The Court set aside the Rights Commissioner’s decision.
