The Labour Court reduced the Rights Commissioner’s €3,500 award to €2,000 on Rianna Construction Limited’s appeal, in a determination signed on 27 January 2009. Mr Wojciech Nowak had claimed unpaid annual leave and public holidays and an incorrect construction agreement rate. The Court accepted that he had been paid the correct rate, but found breaches involving annual leave and public holidays. It calculated €537.24 for leave and €232.32 for public holidays, and set €1,230.44 compensation for those breaches and failures to keep records, bringing the total to €2,000.
