The Labour Court increased Dariusz Serkowski’s compensation from €430 to €650 after finding working-time breaches by Dublin Meath Growers. It also ordered payment at the correct hourly rate for outstanding annual leave in a determination signed on 26 January 2009. Serkowski, a loader, had appealed a Rights Commissioner’s decision. The Court found his average working hours exceeded the legal limit by one hour a week. It also found breaches involving annual leave and public holidays, some later corrected or technical in nature. The employer had agreed to adjust the rate for outstanding annual leave, and public holidays had been paid at the correct rate. The Court varied the earlier decision.
