The Labour Court varied a Rights Commissioner’s decision and awarded Stephen Poleon €1,500 after finding Bernard Weldon contravened the Organisation of Working Time Act over annual leave. The determination was dated 3 April 2009. Poleon said he received less than his statutory entitlement; Weldon said he had provided 36 days over 21 months. The court found Weldon had not kept required records, so he had to prove he complied with the Act. Faced with conflicting evidence and significant doubt about how much leave Poleon had received, the court resolved the doubt in his favour. It found Poleon was entitled to 35 days’ leave and believed he had received at least 20 days. The €1,500 compensation was in full and final settlement of the claim.
