The Labour Court allowed Leitrim County Council’s appeal and set aside the Rights Commissioner’s decision, including its €500 award to Alan Martin. The determination was signed on 2 March 2009. Martin’s complaint concerned three public holidays during certified sick leave over Christmas 2006. He argued that he should receive three days’ leave in lieu. The Council said it paid the public holiday benefit separately and did not deduct those days from his sick leave. The Court found Martin received his full sick-pay entitlement as well as pay for the three public holidays, and concluded that the Council had not contravened the Organisation of Working Time Act 1997. The complaint therefore failed on its merits.
