The Labour Court overturned a €7,500 award to Ryszard Suchowiecki after Gold Force Security MGT’s appeal, finding his average working hours did not breach the Organisation of Working Time Act. The determination was signed on 9 February 2009. Suchowiecki worked as a security guard for Gold Force Security from 13 January to 5 November 2007 and claimed he had been required to work excessive hours. The Rights Commissioner had found the complaint well founded and awarded him €7,500. The Labour Court reviewed records covering the 27 weeks he worked and calculated an average of 47.59 hours a week. It concluded that the employer had not contravened the Act and set aside the earlier decision, finding the complaint not well founded.
