The Labour Court rejected David Mc Gauley’s appeal over public-holiday pay at Beaumont Hospital, upholding the Rights Commissioner’s decision that his complaint was not well founded. The determination was signed on 22 October 2009. Mc Gauley said he was owed a day off in lieu after being called to work on a public holiday in August 2006. Beaumont Hospital said his entitlement had been met. The Court found he was on paid stand-by and was not required to be at the hospital, so he received a paid day off. When called in, he was paid at least four hours at double time plus a travel allowance.
