The Labour Court disallowed Philip Matthew Courtney’s appeal and affirmed the Rights Commissioner’s decision that his annual leave complaint was not well founded. The Court accepted records showing he received 18 days of paid holidays against an entitlement of 14.5 days. Courtney had worked as a legal secretary for Patrick T Durcan & Co Solicitors. The Labour Court extended the time for bringing the claim, then rejected it on the evidence. Its determination was dated 1 August 2008.
