The Labour Court upheld a Rights Commissioner decision rejecting Tom Whelehan’s claim over an allegedly defaced clock card. The determination was dated 11 July 2008.
Whelehan said a question mark was placed beside his leaving time after he clocked out for a medical appointment, which he said he had told his supervisor about. He argued that the alteration questioned his honesty and integrity. The HSE denied deliberately changing the card or trying to deceive him, and said earlier workplace issues had been dealt with in a mediated settlement. The Court found no reason to alter the earlier decision and upheld it.
