Labour Court upholds public holiday benefit for An Post worker

The Labour Court affirmed a finding that An Post owed Glenn King a separate benefit for two public holidays during paid sick leave, dismissing the company’s appeal. The determination was signed on 24 January 2007. King, an auxiliary postal sorter at An Post’s Dublin Mails Centre, sought the benefit for Christmas Day and St Stephen’s Day. An Post argued that its sick pay scheme had already paid him for both days. The Court found those payments counted against King’s contractual sick pay entitlement and did not also meet the statutory public holiday obligation. It affirmed the Rights Commissioner’s decision directing An Post to provide the statutory options for the two holidays.
