The Labour Court awarded Dorota Juzko €800 after finding Pale Space Art Gallery Cafe breached three working-time rights. In its determination dated 9 October 2006, the Court allowed her appeal from a Rights Commissioner decision that had dismissed her complaints after she did not attend the hearing; the merits were not decided at that earlier hearing. The Court found that the employer failed to provide the benefits due for the August 2005 public holiday, pay for six days of annual leave due when her employment ended, and at least 24 hours’ notice of weekly rosters. Her separate complaint about daily rest was not well founded. Juzko said she received short breaks and had to check changing rosters, sometimes at short notice. The employer said she received proper breaks, was paid for 40 hours each week, and staff knew their rosters at least a week ahead. The Court noted that the employer had not kept the required working-time records and therefore had to prove compliance.
