The Labour Court reduced Dean Malone’s holiday and public-holiday award from €1,500 to €1,000 on Rocklands Service Station’s appeal. The determination was dated 5 July 2006.
Malone said that while working for the company, then called Dala Property Management Limited, in 2003 and 2004, he worked weekends and sometimes 40 to 50 hours a week without overtime, holiday pay or extra payment for public holidays. The employer said he had been paid all monies due and averaged 20 hours a week.
A Rights Commissioner upheld the complaint for 29 days’ holiday and public-holiday pay for Malone’s final year of employment and awarded €1,500. The Labour Court noted the employer had failed to keep adequate records and varied the award to €1,000.
