Labour Court dismisses Joseph Nulty’s appeal over overtime premia

By Rory Hanlon

Labour Court ·

The Labour Court dismissed Joseph Nulty’s appeal over unsocial-hours and overtime premia, affirming the Rights Commissioner’s decision. Its determination was signed on 20 December 2005. Nulty said DHL Express Ireland Ltd had not paid the correct premia. The Court found that the Act provides for unsocial-hours payments only for Sunday work, which Nulty did not do, and that the employer had not breached the Act’s working-hours provisions. Nulty had given no new grounds to substantiate a breach and was bound by an earlier Labour Court recommendation on the claim.
