The Labour Court directed Aertec Satellite & TV Services Limited to pay David Cole €2,500 after finding the company had not implemented a Rights Commissioner’s decision. The determination was signed on 5 September 2005. Cole brought the complaint under section 28(8) of the Organisation of Working Time Act 1997. The Court found the earlier decision had not been carried out and that the company had not appealed it within the time limit. It determined that Aertec must pay Cole in accordance with that decision.
