The Labour Court upheld a decision requiring Banjos Amusement Arcade to pay a worker two weeks and two days’ pay for holiday and public-holiday entitlements. The determination was signed on 18 May 2005. The employer appealed the Rights Commissioner’s decision. The worker could not attend the Labour Court hearing because of work commitments. The Court found that the employer’s records did not show when holidays were taken or how much holiday pay had been paid, and that the employer had not proved it complied with the law.
