The Labour Court varied the award to Paula Doyle after Abbey Court Hostel appealed a Rights Commissioner’s decision. It retained €376 for annual leave and substituted €800 for the Sunday-work compensation, setting total compensation at €1,176. The determination was dated 17 November 2003.
Doyle complained that she had not received her full holiday entitlement or a Sunday-work premium. The Court was not satisfied that Abbey Court Hostel had proved she was paid in full for annual leave, and it agreed she was due a Sunday premium. It also held that including holiday pay in basic pay was inconsistent with the Act and that a contract term providing for it was void.
