The Labour Court allowed Michael Neary's appeal against a time-limit ruling and directed Cementation Skanska (Formerly Kvaerner Cementation Limited) to pay him €500 compensation. The determination was signed on 7 November 2003. Neary claimed unpaid annual leave and public-holiday pay; the company said premium payments covered holiday pay and argued the claim was out of time. The Court considered alleged breaches from 12 April 2000 onwards and found Neary had not received his full entitlements during the relevant period. It set aside the Rights Commissioner's decision, found the complaint well founded and awarded compensation, taking account of his pay rate and average bonus.
