The Labour Court rejected Paul Fennell’s appeal over holiday pay calculated without overtime, affirming the Rights Commissioner’s decision. The determination was dated 2 September 2003. Fennell worked 60-hour weeks for most of the period from 19 July 2001 to 26 June 2002 and received 20 days’ holidays calculated on a 40-hour week. J.A.C. Security accepted the Rights Commissioner’s decision. The Court found the calculation complied with the Organisation of Working Time Act 1997 and the relevant regulations.
