The Labour Court upheld Laura Patchell’s appeal and amended the Rights Commissioner’s recommendation, determining that Prime News Limited pay her €1,136.58 for 34.1 days of annual leave and €239.98 for nine public holidays she did not work. The decision was dated 8 January 2002.
Patchell said she received no holiday pay while employed by the company. Prime News said holiday pay was included in her weekly pay. The Court found that paying holiday pay as part of basic wages could not replace the employee’s entitlement to paid leave and public holidays.
