The Labour Court rejected Group 4 Securitas Ireland Ltd.’s appeal and upheld Mr Pat Lynch’s holiday-pay claim. In a determination dated 25 October 2002, it found he was entitled to 32 hours’ pay at his composite rate for the holiday year from 1 April 2000 to 31 March 2001. The company said his contracted week was 40 hours and industry practice supported calculating annual leave pay on that basis. The union argued that he normally worked 48 hours a week and holiday pay had been calculated on 40. The Court found his normal weekly pay included paid breaks and should reflect 48 hours at the composite rate. The amount was to use the rate paid when he took annual leave.
