The Labour Court disallowed John Loughnane & Sons Joinery Works Limited’s appeal and affirmed a €635 compensation award to Eamonn Bodkin for unpaid annual leave. The determination was signed on 29 August 2002.
Bodkin said he received 15 days’ leave in 1999–2000 and 14 days in 2000–2001. The company claimed he had received his full entitlement, including paid time off and leave payments when his employment ended. It had not kept the required records to show how much annual leave he received.
The Court found a shortfall of 7.66 days across the two years, valued at €486.33. The Rights Commissioner’s €635 award accounted for the financial loss and the inconvenience of processing the complaint; the Court found it appropriate and affirmed it.
