The Labour Court affirmed the Rights Commissioner’s decision and disallowed Thomas J. A. Kelly’s appeal over annual leave. The determination was dated 14 August 2002. Kelly said he was still owed 12 days dating from 1970. Dublin Bus said he had received all leave due under the Organisation of Working Time Act 1997. The Court found that he had received the annual leave to which he was entitled in each year covered by the Rights Commissioner’s investigation.
