Labour Court denies Jim Lynch’s appeal over out-of-time annual leave complaints

The Labour Court denied Jim Lynch’s appeal against two decisions that his annual leave complaints were out of time. In a determination dated 2 May 2001, the Court found he had not shown reasonable cause for missing the six-month time limit and knew the Act and its procedures. The Department Of Defence argued that the claims were lodged late. Lynch said he wanted leave reallocated after absences for medical reasons; the Department disputed that he had been compelled to take leave. The merits of the annual leave complaints were not decided.
