The Labour Court determined that Genesis Group put a disciplinary and grievance procedure in place for Amicus members, with provision for employee representation. It also recommended a 3% pay increase from 1 July 2005, with the remaining phase due six months later. The determination was signed on 22 September 2005. The union had sought a determination on an earlier recommendation. Genesis Group did not attend the hearing but sent written communications, which the Court considered. The Court rejected the union’s request for collective bargaining recognition, while recommending representation in individual grievance and disciplinary matters. The Court said the first and second phases of Sustaining Progress, totalling 3%, should be paid from 1 July 2005, with the remaining phase six months later. It took account of the company’s financial circumstances and its stated pay rates. The determination was to be implemented within one month, with retrospective effect to the date in the original recommendation where specified.
