The Labour Court said it had no jurisdiction to consider Miroslav Avizen’s complaint that he was not paid the appropriate rate for his work. The determination was signed on 16 April 2013; the merits were not decided. The Court said the dispute did not come within section 15(1) of the Employees (Provision of Information and Consultation) Act 2006, and that none of the referral conditions in section 15(2) had been met. Avizen had referred the case to the Court in November 2012. S & S Hygiene Ltd did not attend the hearing.
