The Labour Court ruled on Tesco Ireland’s appeal and Mandate’s cross-appeal over equal pay for a crèche supervisor at the company’s Lucan branch. Its determination, dated 25 June 2001, upheld the finding that her work was like that of 14 male comparators. The Court determined that she was entitled to a responsibility allowance equal to 7.5% of her basic pay and a pay adjustment matching comparator E’s, worth £20 a week. Arrears were payable retrospectively from 27 March 1995. The Court accepted Tesco Ireland’s defence on overtime and service pay, but found it had not justified the differences in responsibility allowances and pay adjustments. Mandate had argued that the Equality Officer’s recommended 7.5% differential did not cover the full pay gap.
