In 2001, the Labour Court upheld an Equality Officer’s recommendation that a Fás worker’s pay difference was based on grounds other than sex. The determination was dated 2 March 2001. The worker argued that a female comparator doing like work received higher pay and challenged the selection process for a higher scale. The Court found that the process had been agreed with the representative body and was fair and equitable. It also found that the worker chose not to apply under that process, and that the pay difference was based on grounds other than sex.
