The Labour Court dismissed Maureen Browne's appeal against a finding that Midland Health Board had not discriminated against or unlawfully victimised her. Its determination was dated 9 July 1999. Browne alleged sex discrimination and victimisation after nursing duties were reallocated, while the Health Board denied the claim.
The Health Board said the reorganisation changed responsibilities and aimed to minimise disruption to staff attendance patterns. The Court found Browne expressed her view about reassignment only after the decision was announced. It also found the male colleague was not reassigned because this would have affected his roster, a consideration that did not arise for Browne. The Court concluded that the reallocation was part of normal management and was unrelated to her sex.
