Labour Court rejects Sandra Dempsey’s sex discrimination appeal against Irish Ferries

The Labour Court dismissed Sandra Dempsey’s appeal against a finding that Irish Ferries Limited did not discriminate against her on grounds of sex. The determination was dated 2 October 1998.

Dempsey said she was denied the chance to apply for a job at associated company Eucon because its manager wanted a man. Irish Ferries denied discrimination and said she had already been offered permanent work elsewhere. Dempsey had withdrawn her separate claim under Section 2(b) during the Equality Officer’s investigation.

The Court heard conflicting accounts of when the vacancy was discussed. It accepted that the witnesses were honest to the best of their recollection, but found Dempsey had not established that sex was the reason she was not offered the job. It affirmed the Equality Officer’s recommendation and dismissed the appeal.
