The Labour Court overturned an Equality Officer’s recommendation that South Eastern Health Board appoint Anne Hallinan to a Grade III post and pay her any salary shortfall, as well as £500 compensation. The Court found the Board’s normal recruitment procedure was free from sex discrimination.
In its decision dated 15 July 1996, the Court upheld the Board’s appeal. Hallinan had alleged sex discrimination after the Board refused to designate her to the upgraded post. The Court found that designation depended on the Board’s organisational needs and that there was no need to depart from normal procedures for this post, which was filled through an open competition.
