The Labour Court allowed the Pharmaceutical Society Of Ireland’s appeal and dismissed the Employment Equality Agency’s appeal seeking implementation of an Equality Officer recommendation. The determination was signed on 15 January 1996. The Society had been recommended to pay £4,000 compensation, but the Court did not maintain that recommendation.
The dispute concerned a certificate confirming that the unnamed worker had completed at least three consecutive years of relevant pharmacy activity during the previous five years. The Equality Officer had found discrimination and recommended that the Society issue the certificate and pay compensation. The Society appealed those findings, while the worker continued her appeal seeking increased compensation and the Agency sought implementation.
The Society issued the certificate in May 1995 after the worker met the criteria. The Court found that the Society had not treated her differently from a male applicant and had not discriminated on the basis of sex. It allowed the Society’s appeal and dismissed the worker’s appeal.
