Labour Court dismisses nurses’ appeal over Mid Western Health Board discrimination finding

The Labour Court dismissed the Psychiatric Nurses Association’s appeal and upheld the Equality Officer’s finding that the Mid Western Health Board had not discriminated against a worker. The Court signed its determination on 22 September 1995.

The Association argued that the Equality Officer’s report omitted relevant material and relied on misleading information. It said the worker’s redeployment and replacement by a nurse of the opposite sex amounted to discrimination.

The Court found no evidence that the redeployment was less favourable treatment than a female employee would have received. It said staff assignments could take account of skills, responsibilities, and the safety and welfare of patients and staff.
