In 1993, the Labour Court rejected Nuala Madigan’s appeal against a finding that the Eastern Health Board did not discriminate when it failed to appoint her as a Community Welfare Officer. The Court upheld the Equality Officer’s recommendation in a decision dated 24 June 1993.
Madigan argued that a Community Welfare Officer’s remark, her experience and the interview board’s marking showed sex discrimination. The Court found the officer who made the remark had no demonstrated influence over the permanent appointment. It also found no basis to treat the Inquiry Officer and Community Welfare Officer jobs as similar or interchangeable. The interview board had set its assessment criteria in advance and assessed each applicant against them after the interview.
