The Labour Court dismissed Mandate’s appeal over a claim that female sales assistants at Tesco Ireland Limited’s Celbridge store were told to clean toilets while male workers were not. The determination was signed on 8 August 2005. The Court said it had not investigated whether discrimination occurred. Mandate had challenged the Equality Officer’s finding that the referral was invalid because no claimant was identified during the investigation. The Labour Court said claimants were named only more than three years later, which it considered not credible. It also found 27 October 1998 was not the first date of the alleged act and that no reasonable cause had been advanced to extend the six-month time limit.
