Labour Court upholds finding of no discrimination against Nui Galway

The Labour Court upheld a finding that Nui Galway did not discriminate against Kathleen Burke when it refused her request to job-share her Assistant Librarian post. The determination was dated 12 August 2002.

Burke said the University had not made enough effort to accommodate her family commitments. Nui Galway said the post needed a full-time employee to provide continuity and a point of contact, and that it considered other arrangements. The Court found objective reasons why the post was unsuitable for job-sharing and said the University had made considerable efforts to accommodate her. It found no discrimination on grounds of sex or marital status, affirmed the Equality Officer’s recommendation and disallowed the appeal.
