In 2000, the Labour Court disallowed Ms Maureen Travers's appeal and affirmed an Equality Officer's recommendation that the Revenue Commissioners had not discriminated against her in a promotion process. The determination was signed on 4 September 2000.
Travers argued that she was treated differently from a male colleague because she had to attend a Review Board to be considered suitable for promotion. The Court found the requirement was not direct discrimination: Travers remained formally classified as unsuitable, while the male candidate was already classified as suitable. It also found the evidence did not support an inference of indirect discrimination from the assessment system. The Court concluded she was not treated less favourably on grounds of sex.
