The Labour Court found that Karen Herbert was covered by the 1988 Law Clerks' Employment Regulation Order for her period working at W & E Bradshaw Solicitors, from 11 October to 23 December 1988. The decision was signed on 23 April 1990, and the Court found she was entitled to the rates specified in the order. Eric H.W. Bradshaw had asked whether the order applied. The firm argued Herbert had been on work experience and then a short trial as a typist; the Department of Labour said she was an employee performing clerical and typing duties.
