The Labour Court found that Pauline O’Loughlin, a trainee at Augustus Cullen And Son Solicitors, was covered by the 1988 Law Clerks Employment Regulation Order for her work from 15 August to 30 November 1988. The Court said she was entitled to the rates set by the order. The decision was signed on 5 April 1990. The firm argued that O’Loughlin was a trainee rather than an employee. The Department Of Labour said the order did not restrict coverage to trained employees and that PAYE and PRSI deductions had been made from her pay.
