The Labour Court found that the Contract Cleaning Employment Regulation Order did not apply to Katarzyna Kalus-Nowak’s work for MCR Personnel Limited. The decision was signed on 5 May 2010. Kalus-Nowak cleaned mostly newly built, unoccupied buildings before handover. She argued the order covered interior cleaning even when buildings were not yet occupied. The company said it provided one-off cleaning for construction projects rather than ongoing contract cleaning. The Court accepted that the company did not provide or compete for the ongoing service covered by the order, and described the work as a construction-type activity finishing buildings for occupation.
