Adjudication Officer Marguerite Buckley found she had no jurisdiction over Rosemarie Mongan’s complaint against Donal & Martha Duffy Limited t/a SuperValu Edgeworthstown in a decision dated 23 November 2017.
Mongan alleged discrimination on the Traveller ground and harassment after she was refused service in the supermarket’s off-licence area. The respondent argued that the Intoxicating Liquor Act 2003 put the matter within the District Court’s jurisdiction. Buckley found the alleged conduct took place on licensed premises, so the merits of the allegations were not decided.
