Equality Officer finds leisure facility did not discriminate over access

By Cathal Brosnan

Workplace decision ·

An Equality Officer found that a leisure facility did not discriminate against Ms B. on disability grounds by failing to provide reasonable accommodation during her family’s holiday. The decision was dated 9 December 2014.

Ms A. brought the complaint on her sister’s behalf. She said the bungalow initially lacked adaptations and described difficulties using the pool and showers. The officer found that staff supplied equipment, offered an accessible bungalow that the family declined, and helped Ms B. use the pool. The officer concluded that the facility and its staff made reasonable efforts to accommodate Ms B.

The officer also waived the statutory notification requirements, finding that the facility knew the circumstances of the complaint and was not prejudiced in the Tribunal proceedings. The complaint about reasonable accommodation failed.
