Equality Tribunal rules pupil’s discrimination and harassment claims outside its jurisdiction

By Cathal Brosnan

Workplace decision ·

The Equality Tribunal found that a pupil’s discrimination, harassment and reasonable-accommodation complaints against a school were outside its jurisdiction. The pupil’s victimisation claim also failed. Equality Officer Tara Coogan dated the decision 16 July 2012.

The pupil, acting through his father, alleged unfair discipline and other unfair treatment at school. A school denied treating him differently and disputed that it knew he had a disability.

The Equality Officer found no evidence that the pupil was protected by the disability ground, so the Tribunal had no jurisdiction over the discrimination, harassment and accommodation claims. She separately found no evidence of adverse treatment for the victimisation claim.
