The Equality Tribunal found against Kathleen Maughan and her daughter Kelly in their case against Clare County Council over alleged discrimination in accommodation and related services on the Traveller community ground, and harassment. The decision was dated 29 May 2009.
Ms Maughan did not attend the hearing on 21 April 2009 to complete her evidence. Equality Officer Marian Duffy found her failure to attend unreasonable and concluded the investigation. The officer said the complainants had not established a prima facie case of discrimination, and found against them after Ms Maughan’s absence; the merits were not decided.
The officer declined the council’s requests to dismiss the complaints for failure to pursue them or as frivolous, vexatious, misconceived or trivial. She also found no obstruction or impediment warranting an expenses award.
