Equality Officer rejects customer’s claims against Dublin bar

By Donal Gilhooly

Workplace decision ·

An Equality Officer rejected a customer’s claims of discrimination, harassment, sexual harassment and victimisation against a Dublin bar, finding that he had not established that the alleged events occurred or were relevant to him. The decision was dated 30 January 2007.

The customer alleged that bar staff interfered with his drinks and that staff and other customers threatened and harassed him. The licensee said the owner had no recollection of him, and staff enquiries and a review of the bar’s incident book found no record of the events. The Equality Officer noted inconsistencies in the customer’s account, including changes in his descriptions of who had touched him, and that he produced no witnesses. The officer found that his evidence lacked credibility and that he had not established a case under the Equal Status Act on the gender, marital status, sexual orientation, religion, age or race grounds. The claims were not well founded.
